General terms and conditions
1.1. The owners of the site GNSS.STORE is "ELTEHS SIA" (reg.Nr. 40103194946, legal address: Latgales 322b, LV-1063, Rīga, Latvija), next in the terms called the Seller.
1.2. When ordering goods through our online shop GNSS.STORE, Customer agrees to the Terms of the sale of goods, described below.
1.3. The relationship between the Customer and the Seller governed by the laws of Latvia.
1.4. Confirmation of acceptance of the Terms, the Customer during the ordering process by selecting the checkbox " I agree with the terms of service and I adhere to them unconditionally." and clicking on the button "Next".
Registration
2.1. Making your purchase is possible only after registration.
2.2. Seller is not responsible for the accuracy and reliability of the information that the Customer indicates in the registration form.
Ordering and Delivery
3.1. The Customer can place order using the form at the registration site.
3.2. When processing orders, customer must specify the following information: Name of the Customer or recipient of the order, delivery address, e-mail.
3.3. Time of receipt of goods depends on the rate of payment for goods and the Seller's courier service.
3.4. Seller does everything that would abide by those delivery times, but there are reasons for delay in order for reasons beyond the Seller responsibility. More information about delivery in the section "Delivery".
3.5. If the Customer cancel the order, but Order still not sent, the amount of canceled orders will be refunded.
3.6. The risk of loss or breakage of goods passes to the customer when the customer receives the order and when the Customer signs the documents, which confirm the delivery.
3.7. If the goods are not delivered to the Customer by reason of its loss at the time of delivery, Seller shall reimburse the costs paid by the Customer of the goods and delivery costs only after he had received from the Service Delivery confirmation about the loss of order.
3.8. If Customer have not received the goods within 30 days. The Customer must contact the GNSS.store shop by using contact form or by email
3.9. Import duties, customs taxes and charges are not included in the item price or shipping charges. These charges are the buyer's responsibility.
3.10. Please make sure your address is correct. We will ship the order to your address left during checkout.
Payment for goods
4.1. Prices for Supplies and goods are in Euro and are exclusive of VAT. All sums payable by the Customer in accordance with these Conditions are exclusive of VAT. Where any Goods are provided by the Seller to the Customer that are subject to VAT, the Seller shall pay an amount equal to such VAT (in addition to any other consideration payable by the Customer) to the Seller and the Seller shall (where required by applicable laws) issue an appropriate VAT invoice to the Customer.
4.2. Types of payment are described on the website in the section "Types of calculation".
4.3. Reservations accepted for further processing only after transfer of the entire amount of the order to the Seller's account, if the failure to specify other terms and types of payment.
4.4. Payment for the order can be made by bank transfer, Credit Card and PayPal.
Warranties and liability
5.1. Warranty from the manufacturer on all products is 1 year. Details in the section "Warranty".
5.2. Seller is not liable for damage caused by the Customer, which arose as a result of misuse of the items.
Return of goods
6.1. The customer has the right to return the ordered goods within 14 days. Returns of the Goods can only be saved, if the Goods appearance are with the consumer characteristics, its original packaging and paper, as proof of purchase of the item from Seller.
6.2. The Customer has no right to return the goods from the special orders, if such goods can only be used by the Customer bought it.
6.3. Based on the law on consumer protection Seller has the right to refuse the buyer to take the goods back or take the compensation if the goods are not returned in their original packaging, packaging is seriously damaged, taken off the protective film on the screen, noticeable slight traces of use, such as scratches.
6.4. The Customer has the right to return faulty goods of the manufacturer or retailer fault and demand a refund during the guarantee period. The customer has the right to require replacement of the Goods of inappropriate quality to the same or require it to eliminate all problems.
Use restriction
7.1. Goods used as is or integrated into others may not be used in military equipment and weapon systems (e.g., systems for identifying of targets by military users), including for testing and simulation of such weapon systems. It includes military UAVs, military unmanned vehicles and military robots.
Goods are not intended for use as Critical Components (as defined below) in or in combination with (a) automated driving assistance device or system in any automotive application and mechanism (except where the goods are ISO 26262 compliant as stated in the data sheet), or (b) any kind of medical life-saving or life support device or system (including any device or system that is intended for surgical implant into the human body or to support or sustain life) and whose malfunction or failure to perform may result in significant injury or death to the user, or (c) any nuclear facilities, or (d) any air traffic control device, application or system, or (e) any other device, application or system where it is reasonably foreseeable that failure of the goods as used in such device, application or system would lead to death, bodily injury or property damage. A Component is Critical when its malfunction or failure to perform may cause the failure of a device or system, or may affect the effectiveness of such device or system. Seller excludes its liability for any prohibited use or a use for which goods are not intended, and Customer shall indemnify Seller from claims resulting from such use.
It is, unless expressly authorized in these Terms and Conditions or by mandatory provisions of law, forbidden to decompile, to detect the source code or the underlying user interface techniques or algorithms of the software, to change, reproduce or develop the software, to take action that would cause the software to be placed in the public domain or open source community or general public libraries, or to reproduce, change or reverse engineer the hardware.
7.2 Export Control and Regulatory Requirements:
Goods used as is or integrated into others is forbidden to export or re-export to any member of the Eurasian Economic Union (including Russia, Belarus, the Republic of Armenia, the Republic of Kazahstan and the Kyrgyz Republic), territories occupied by Russia in Ukraine, and Iran.
Customer represents that the goods will not be shipped to any countries subject to embargo, export controls or other restrictions under any applicable law or regulation and that he/she is not on a denied person or entity list. Customer is obliged to comply with the regulatory requirements applying to the goods as indicated in the respective documentation (e.g. U.S. FCC or IC regulations).
7.3 A breach of the obligations and representations in this clause constitutes a material breach and Seller may terminate any contractual relationship with the Customer with immediate effect. In addition, Seller may claim a penalty of 10% of the Goods sales price shipped to Customer during the 12 months preceding the breach. At Sellers request, Customer will sign a letter confirming the use restrictions, listed in the items 7.1...7.3 above.
Other conditions
8.1. The relationship between the Customer and the Seller governed by the laws of Latvia.
8.2. In case, any issues and claims Customer should contact our customer service via the website or by e-mail. All of the dispute, the parties will try to resolve through negotiations. If you can not reach agreement, the dispute shall be referred to the judicial authorities of the Republic of Latvia in accordance with the laws of Latvia.
